Recess Open Meeting in order to conduct Closed Executive Session for consultation with attorney to receive legal advice concerning the following threatened, contemplated or pending claims and litigation, and to deliberate other matters as authorized by Texas Government Code Chapter 551 relating to: 11. *Private consultation with the City Attorney to seek advice concerning pending or contemplated litigation. (Sec.551.071). *Private consultation with the City Attorney related to a matter in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with this chapter (Sec.551.071). *Deliberation concerning the purchase, exchange, lease or value of real property, to include but not limited to MSEC, Inc. Water & Wastewater Assets (Sec.551.072). *Personnel Matters, to include but not limited to the City Secretary (Sec.551.074). M. Garner

Discuss and Consider authorizing the expenditure of an additional $150,000.00, payable to the law firm of Denton, Navarro, Rodriguez, Bernal, Santee & Zech, P.C. to defend the City in a pending litigation: John Sellars v. Duke W. Coon, in his official capacity as Mayor of the City of Conroe, Texas, and the City of Conroe, in Docket No. 25-12-197763 in the 457th Judicial District Court of Montgomery County, Texas to protect the attempt of John Sellars to overturn the will of the voters amending the City’s Home Rule Charter. Discuss and Consider authorizing the City Attorney to engage a law firm and the expenditure of funds not to exceed $250,000.00 in pending litigation: Conroe Professional Fire Fighters Association vs. City of Conroe, Texas, Sami Quinlan, in her official capacity as Conroe Interim City Secretary, in Docket No. 25-12-197763 in the 284th Judicial District Court of Montgomery County, Texas.
